if you remove the font (the actual TTF file) so long as the rest of the graphics in this pack are legit made by you then i see no reason why this mockup would not be considered useful game art. in fact, it has an extra layer of usefulness due to some mockup levels being provided.
what is the license of the photo? "based on" makes it sound like it is a derivative work. if so, the photo needs to be from a compatible-licensed source.
