Unfortunately, it looks like using the likeness of celebrities (or non-celebrities) is a murky area unless permission to use it is explicitly granted for the given use. I think this asset is hilarious and I'd rather it remained available, but OGA has to be the place where our assets are not legally murky.
I try to avoid this kind of "It's all good, no wait maybe not, ok yeah it's fine, or is it?" rollercoaster, so please accept my apologies, but I'm afraid assets portraying the likeness of real people can't be hosted here. :(
Thanks for all your help with the site. I really appreciate it. :)
Sure! My goal is to handle all the monotonous small stuff so you don't have to spend your limited time on it. Hopefully freeing you up to handle the larger things that I can't (like the search indexing. yay!) I know you have little time with your family and job, so thanks for bringing the big guns when you can. :)
Quick edit: To be clear, that post with Trump's likeness will probably have to come down based on the legal issues with likenesses. Unfortunately, we're going to have to thoroughly explain any reversals of admin decision, because people tend to get mad about that.
Understood. I'll draft a response to that explaining that new legal information has come to my attention and, unfortunately, likenesses of people are murky so we will not be able to host the asset. As for similar cases, there is also the likeness of rick grimes (andrew linkcoln) that Master Redshrike flagged until the character name was removed. Should we re-flag that one as well, with a similar explaination and apology?
EDIT: also, dorothea the cat lady is still flagged licensing issue, but because of the image on her T-Shirt looking very much like a photo ripped from google search. However, that image on the T-Shirt may fall under the likeness rule as well. Same?
The warning was not explicitly for a potential ban, but for what is and is not allowed on OGA. It progressed into two PM exchanges (one of which I deleted thinking the issue was resolved) and concluding with MikeeUSA agreeing to have the political and religious content removed from the submission: http://opengameart.org/messages/view/2131
Some time in here undesired a.k.a. leilei mentioned that MikeeUSA's behavior was not a new thing and made me aware of some past problems both here on OGA and elsewhere on other FOSS sites in general. http://opengameart.org/messages/view/2129
The 2nd time was a warning I made on the ChaosEsque Anthology thread http://opengameart.org/forumtopic/chaosesque-anthology-opensourcefree-fp... about being disrespectful and discussing politics and religion again. in it I took a harsher light after knowing about MikeeUSA's other activity and warned of a ban in the comment.
After reflecting on it some I felt that perhaps MikeeUSA's actions on other sites probably shouldn't influence my reaction to him here on OGA. He continued making the same sorts of comments on the Chaosesque thread, so- in what I now beleive was a misguided attempt to redeem him- I deleted several of the worst of his offending comments along with my ban warning (I know, I screwed that up. :/) and I PM'ed him again asking if he could remove the toxic comments and political/religious content from his content moving forward. http://opengameart.org/messages/view/2255
At this point chasersgaming PM'ed me about the ChaosEsque Anthology thread (which continued to escalate) These being a few of the less offensive posts:
In the PM http://opengameart.org/messages/view/2411, Chasersgaming mentioned Botanic giving a ban warning earlier in the same thread: http://opengameart.org/comment/38695/comment-38695 At this point MikeeUSA continued to post political, religious, and disparaging comments on the thread, so I emailed him letting him know that unless he changed his posts in the next 48 hours, I would be banning him. I received no response, which I guess is probably because he doesn't check his email, but my patience was spent, so I banned him and posted on the Chaosesque Anthology thread indicating as such. http://opengameart.org/comment/55702#comment-55702 MikeeUSA's submissions were never taken down or blocked from anyone's access. Only his account was locked. Deepest apologies if this results in any strife on your part.
lucaslm, would you be willing to replace the textures with similar ones under a compatible license? I appreciate you listing the source of the textures. That is the right way to do it. Unfortunately, the source of these textures don't list a license for their use, which is usually a bad sign. This has only recently come to my attention. There may even be some viable replacement textures here on OGA :)
lucaslm, would you be willing to replace the textures with similar ones under a compatible license? Unfortunately onlygfx.com textures doesn't allow redistribution of their textures by themselves, where CC-BY implies that it is allowed. This has only recently come to my attention, but I have to mark it as having a licensing issue for now. There may even be some viable replacement textures here on OGA :)
The post doesn't, but replies to it (and any other post in this forum) do: http://opengameart.org/user/3656/comments
Some new legal information has come to light concerning using someone's likeness. http://www.dmlp.org/legal-guide/using-name-or-likeness-another

Let me know if you have any questions.
Cool. Would you be able to link to the specific texture(s) you used from darkwood67's gallery?

Regarding MikeeUSA's ban and warnings: My own warnings to MikeeUSA started with my commenting on his Jam Session submission http://opengameart.org/content/keyboard-jam-session-keyboardjamsession2016

Try posting to that forum with the same content now, zabin. You shouldn't get the spam thing.
Nice!
