qudubup mentioned that the trademarked logos (martini etc) could be an issue, so if you want to be extra careful edit these out of the skin before using the model.
There is also the fact (concerning the programmers VS artists point) that with art there is no such thing as closed source. You can freely take inspiration and copy (&paste) from any source. Sure plagatising is a big issue in artists circles when it comes to actually publishing works, but for learning and all that it's considered ok. Therefore artists never get into contact with the idea of open-source, while a programmer frustrated by not being able to see the source of the program will sooner or later automatically find some open-source implementation of the problem (and thus know about open-source and the idea behind).
Since that is a running bird it might fit well to the fast running game-play of sonic. For the other characters you can maye use other animals native to Newseeland (or Australia)? Or maybe just strange animals like a http://en.wikipedia.org/wiki/Platypus and a http://en.wikipedia.org/wiki/Dodo
Edit: Or make it birds only, with a kiwi, a penguin (hey it doesn't have to look like tux) and a parrot?
Edit2: If you are rendering it from a 3D model please make sure to also release the mesh for later possible modifications!
Pretty nice so far, but I would seriously consider re-rendering everything at a higher resuloution if possible. Right now all the sprites look really blurry and it is IMHO just a bit too low resolution.
What is it currently rendering at? 640x480? Make the target resulution at least 800x600, or better 1024x768! Sure it might loose a bit of its retro charme, but right now all the nice assets are a bit wasted because the resolution is too low!

Sounds like you want to decide what language to start learning, right?
Well in that case there is a definite answer I think: Python!
Easy to learn, great learning material available, good "compilers"/VM and libs(incl.gui), not limited in concepts and a syntax similar to C++.
Make your self usefull and do some promotion of OGA instead of spamming this forum :p

That RPG sound (and looks) great! Hopefully it will include a multiplayer (coop) part.
Are you writing the 2D engine from scratch?
