Hi Saa_Matt,

unfortunately this is not my music, but I do love it as well. That is why I posted it here. It is done by The Orchestral Movement of 1932 and fourstones.

It is thankfully under the CC-BY license, meaning you need to attribute both of them in your credits, but can use it anywhere. I am not a lawyer though and have no clue of the exact requirements.

Considering appstore needs bundling, and those are share alike licenses this might be hard by licenses alone. At least to my understanding.
Can you tell me a bit about this game? Do you have a website for it already?

that depends on what kind of license your game uses and how you re using this one. All licenses that this is under demand at least mentioning my name and licensing the created work of art as the same license.

This seems to be fault of jamendo. It used to be a Creative Commons portal and now they want to make money by licensing commercial media. Of course this doesnt mix well with the old way and they seem to dilerbately hide the license information. It is really annoying and disappointing as someone who used to use as well as release on jamendo.

I uploaded this a very long time ago though and that is definitely the right license for it. Archive org has it uploaded with the same license that you can look up in the license.txt there: https://archive.org/details/jamendo-033287

Edit: I thought this was the wrong license. You just relicensed your own song under a new CC license for OGA, right?

my understanding is that you would have to license the game under CC-BY-SA as well, as the music cannot be switched out of the game. I am not a lawyer though.

Could you write me your real full name and the name of the game in a private message? I can give you a one time license for free, if you write me those.

Hi Luca,

while you're free to use the music for commercial games, my understanding is that you have to put the whole game under Creative Commons BY-SA license if you make the music integral part of the game, The only exception is it is in a folder and you can easily replace the music the game plays. So in most cases like any app store games, youd be forced to make it an integral unchangeable part of the game and therefor need to release the game under the same license. That is my understanding of the license.

Can I ask which game it will be used for?

I think the age of the submission is only relevant that I did use the specified license by author back then, as the change of license on jamendo only appeared recently. I also wrote him that it is uploaded to opengameart on jamendo at that time as a comment to his tracks.

Basically I think my upload and OGA hosting it is both 100% legal and morally OK.

I do think that it is a good culture to work closely with the author though. If Harold is interested in taking those submissions down, you have my blessing to delete those. Those are beautiful tracks, which is why I uploaded them, and I do hope they will stay up for the community though.
