Well, I think no one here is a lawyer? :) But as I understand it, the danger is that courts do argue about "similarity" (I dont understand it: http://en.wikipedia.org/wiki/Substantial_similarity ) so if something is pretty obviously very similar, it's dangerous. And this is a whole spritesheet, laid out in a particular size and format.
A bit like disney has a copyright on mouse ears ;)
iappscrazy, if you search for "chess" in 2d art you'll find a few complete pawn sets and boards. you could use those as placeholders (i think they actually look pretty decent).
did you consider rendering the terrain in 3D? since you already have the data to do that. i think it should be possible to make it look like pixel art with the right textures and maybe a nifty shader. and if you only allow 4 camera rotation (and not arbitrary rotation), that might also make it easier to make it look 2d pixel-artish.
i want to make it open source but i also want it to be:
1) instantly compelling to play (if you know the genre) 2) easy enought to contribute to
1) is 90% there and 2) i haven't started yet.
for 2) i'll have to cleanup the setup and how contributors can add/change art or tune the economy. it's fairly easy to add buildings and how those and the units interact (JSON files). i'll have to write up some documentation about how this works (even if it's just a list of pointers to config files) and then set aside time to "deal with" potential contributers.
right now, my todo list for 1) is down to 3 pages. if everyone loves the free demo :) which i have promised myself to release in october, i'll start dealing with 2).
i get that people are less interested in contributing when there contributions go into someones private repository. that's why i'm not asking for contributions... yet. and btw: thanks for the interest :)
you would just have to "Submit Art" and select the LPC tag or just name them "Redone .. bla" and paste your above explanation of what was changed into the description.
@medicinestorm: wow thanks for asking. now we know for sure.

eh, that screenshot actually looks interesting. will check it out in the evening.
looks pretty cool. do you know whether there's a way to try it on linux? would even download a plugin if necessary :)

regarding the shadows suggested by reemax: here's one such technique described http://www.lostgarden.com/2007/05/cutegod-prototyping-challenge.html under "Shadow Tile Placement"
