Edit: Issue was resolved.

Fair use does not apply on OGA because content must be given an explicit license. OGA is never a user of content, so OGA cannot benefit from fair use. People who browse OGA can benefit from fair use, but OGA can't host content that is only allowed under fair use. It must be allowed under other terms instead/as-well; namely, the terms of the explicit license.

As of the 3rd of this month, the trademark for "Commodore 64" is active.

However, the "Commodore 64 collor pallet" (sic) is referencing neither the art itself, nor any copyrightable content since color palettes can't be copyrighted and the artwork itself is unrelated to the trademark in representation or name.
