Ok. Unfortunately, non-commercial projects are still subject to copyright and trademarks as weird as that is. viacom could issue non-commercial projects that use this with Cease & Desist letters. I doubt they would unless the project got a lot of attention, but that's the worst time to get that kind of news for your project. I think it's general enough to still be used, but only if it weren't associated with TMNT. "Green Amphibian Icecream Bar" or something. :)
